1 – LEGAL CONDITIONS AND THEIR ACCEPTANCE

When using the services of RAG Sistemas or contracting any services from RAG Sistemas, users, as understood, all those who in any way are using the services of RAG Sistemas  and its applications, Sistema Gestor and Gestor Mobile, whether through formal contracts or not, will be expressly adhering to the policy and conditions of use, privacy and security specified here.
The version of these Conditions of Use sets out the conditions in force at the time, in order to reflect the rules that prevail and are accepted. For this reason, all users must carefully read these conditions before using RAG Sistemas services and its applications.
RAG Sistemas reserves the right, at its sole discretion and without prior notice, to modify or alter this policy and the conditions of use, including new conditions and/or restrictions that may be adopted by companies linked to the System's services. Gestor and Gestor Mobile, as well as by the aforementioned association, which is why it is recommended that the user, when using the services provided by the Gestor System, proceed as usual to read the usage policy and the conditions of use contained in this document /site.
Please note that the use of the Management System and Mobile Manager services by the user will imply unrestricted acceptance of the established conditions, including any changes that may be made.

This Policy is inserted in the Sistema Gestor and Gestor Mobile Applications and will be periodically accepted by the User Company through the acceptance of its users.

2 - RULES FOR USE OF THE SERVICES PROVIDED BY RAG Sistemas AND ITS APPLICATIONS, Management System and Mobile Manager

The use of certain services and access to information will only be made available to users previously and duly registered as users of Sistema Gestor and Gestor Mobile, or who have a signed contract with RAG Sistemas.
RAG Sistemas reserves the right to change the availability of information according to the different types of Service Plans to be chosen by users and according to its Use License Acquisition Agreement, its Annexes and subsequent Addenda.
Users are obliged to use the entire Gestor and Gestor Mobile System, always in a lawful manner, with reproduction, distribution, transformation, commercialization or modification of the content and its structure being prohibited, without the prior and express authorization of RAG Sistemas, depending on the devices contained in this Instrument and in the Use License Acquisition Agreement.

Users who are registered by their Companies, which are clients of RAG Sistemas, undertake, in turn, not to transmit or disseminate content owned by the Client Company, which violates the legislation in force in the country, morality, good customs and public order; also being responsible for the management and insertion of data that do not in any way violate the rights of third parties and current legislation, observing the rules contained in the aforementioned chapter of this Instrument.

Users are prohibited from manipulating, altering, misrepresenting or suppressing RAG Sistemas' copyright identifying data, as well as digital brands, logos, banners, signs, symbols, or functionality and protection devices of the Management System and Mobile Manager hosted by RAG Sistemas.
The reproduction, in whole or in part, of any content from Sistema Gestor and Gestor Mobile is also expressly prohibited, without the prior and express authorization of RAG Sistemas.

3 - PERSONAL IDENTIFICATION AND ITS DISCLOSURE

To access information, users must be registered in the Member's area (Company-Client) providing personal and/or professional data through the Member's employee registration.
Messages containing data from the Client Company (Associate) eventually sent by registered users are the sole responsibility of the Associate, exempting RAG Sistemas from any responsibility for this content, since the sending of information takes place outside the Management System and Mobile Manager .
Registration information is used solely by Associates and is not shared with third parties for any purposes, not even by RAG Sistemas, in accordance with the Usage License Acquisition Agreement and the General Data Protection Law.
RAG Sistemas does not collect or compile personally identifiable data for disclosure or sale to third parties for any purposes, including the content of the Member Database that is protected by law, as per the specific Clause of the Use License Acquisition Agreement.
If users subsequently need to access, modify or delete any data from the registration made, procedural instructions will be given, in the Member's specific area, by Technical Support.
Exceptionally, RAG Sistemas will disclose user data and information to third parties only when required by the competent authorities and duly documented.
RAG Sistemas is not responsible for the acts of third parties who manage to collect or use, by any means, registration data and information made available through the Gestor System and Gestor Mobile.
RAG Sistemas and its Sistema Gestor and Gestor Mobile are not responsible for data or information provided by users, nor for the content of the messages transmitted.

4 - PASSWORDS

Registered users will define a personal password to access the Management System.
In this way, users undertake to use the password in a safe and confidential manner, ensuring its safekeeping and confidentiality, declaring that they are aware that they will not be able to sell, transfer, assign or lend the password to anyone else, under any circumstances. , which is personal and non-transferable.
The loss, theft or loss of the access password by users must be immediately reported to the senior management of the Client Company (Associate), so that they can block it and provide a new access password. Users are aware that until they are notified of this occurrence, users will be responsible for acts carried out by third parties, through the use of the password, which cause damage to servers, third parties and other users of the Management System, Mobile Manager and from RAG Sistemas.
Users are fully responsible for any loss or damage they may suffer or cause to RAG Sistemas, its Management System and Mobile Manager and the Client Company (Associate) and/or third parties, as a result of inappropriate or improper use of their password, whether due to culpable or intentional conduct.
RAG Sistemas is exempt from any and all liability arising from the improper, negligent or reckless use of access passwords granted to its users.

5 - SECURITY

1. Copyright, Intellectual Property and Privacy
It is prohibited to use a connection with RAG Sistemas and its Sistema Gestor and Gestor Mobile to commit or be an accomplice to acts of violation, deception, manipulation or suppression of the Copyright or Intellectual Property of any person, through reproduction, copying, distribution or public availability of any material, without the authorization of the owner or without due legal authorization.

2. Data collection
RAG Sistemas, through its Sistema Gestor and Gestor Mobile applications, does not collect any data from your Android device. It only uses the reading, through the camera, of the data to be transmitted. It further declares that such information is transmitted encrypted and directly to the Client Company's database. The Gestor and Gestor Mobile Systems do not collect personal, confidential information or through the Geofence process.

3. Consequences of Violations
Punishments resulting from non-compliance with this policy and conditions of use range from a formal warning to the offender, to the immediate termination of the provision of services by RAG Sistemas and its Sistema Gestor and Gestor Mobile, being applied in accordance with the provisions of the Acquisition Agreement of Use License and other services of this Policy, without prejudice to the criminal and civil liability of the offender, in accordance with current legislation.

Please note that the rules mentioned above generally cover conduct that violates regulations, rules and norms accepted by the Member as a whole. However, matters not covered in this Policy, which are provided for in specific rules or standards, are also fully applicable and are subject to respective punishments.

 

6 - RESPONSIBILITY FOR THE CONTENT OF THE Management System and Mobile Manager

RAG Sistemas is not responsible for any type of data entered or collected in the Member's Database and provided by it, even if it is eventually and temporarily suspended.
The Management System and Mobile Manager or their content are not free from errors, and there is no express or implicit guarantee that it will be suitable for the particular purpose of the Client Company (Associate) and its users when using them.

 

7 - RESTRICTION ON THE USE OF THE Management System, Mobile Manager AND OTHER SERVICES

If RAG Sistemas, based on this Use Policy, considers the use of its Management System and Mobile Manager or other services made available to the user to be inappropriate, it may, at its sole discretion, impose restrictions on the use of the services on the user.

FINAL CONDITIONS

Regardless of the imposition of the restrictions provided for in this Policy, RAG Sistemas, at its sole discretion, reserves the right to cancel access to the Gestor System and Gestor Mobile, terminate the service provision contract or refuse user registration, if the user fails to comply with any item of the conditions of use specified here as well as the supply conditions specified in the Acquisition and Concession of Use Agreement.
Users who violate these conditions of use will be held responsible for damages of any nature that RAG Sistemas may suffer or those caused to third parties.
